Terms of Service

We believe a fair agreement is a simple, honest one. These terms are written in plain language so you always know exactly where you stand with us, what you can expect from the service, and what we ask of you in return. There is no fine print designed to catch you out.

Agreement

These terms govern your use of BusinessMitra, a WhatsApp AI assistant service operated from Gorakhpur, Uttar Pradesh, India. By creating an account or using the service, you agree to these terms. If you do not agree, please do not use the service.

The service

BusinessMitra provides an AI assistant that replies to your customers on WhatsApp, answers questions about your business, helps customers browse products, and takes appointments, along with a dashboard for managing your customers, messages, products, appointments and settings. The assistant and dashboard adapt to your industry and business type. Features are added and improved over time and may change.

Live demos

You can book a live demo for a small fee shown at checkout. A demo lets you experience a sample assistant, matched to the industry and business type you select, on your own WhatsApp number for a limited period. Actions inside a demo — such as bookings, orders, broadcasts and payments — are simulated for illustration and are not real. As with other payments, the demo fee is non-refundable except where required by law; if anything goes wrong with your demo, contact us and we will review it fairly and do our best to make it right.

Your account

You are responsible for the information you add, for the messages sent from your account, and for keeping your login credentials confidential. You must provide accurate business details and ensure you are authorised to use the WhatsApp number connected to the service.

Acceptable use

You agree to use the service lawfully and in line with WhatsApp's and Meta's policies. You will not use it to send spam, deceptive, unlawful, harassing or abusive content, and you will not misuse the assistant to mislead your customers. We may suspend accounts that break these rules.

Plans and billing

Paid plans (Starter, Growth and Premium) are billed at the prices shown on the pricing page and are processed securely through our payment provider, Razorpay. Plans are offered on a subscription basis for the duration you select. You can upgrade from your dashboard, paying the applicable difference. Access to paid features continues until the end of the paid period.

Cancellation and refunds

You may cancel at any time; your plan then remains active until the end of the current paid period and is not renewed. Except where required by law, payments already made for a period are non-refundable. If you believe you were charged in error, contact us and we will review it fairly.

Third-party services

The service depends on third parties including Meta's WhatsApp Cloud API, AI providers (Google Gemini and Groq) and Razorpay. Their availability and policies are outside our control, and interruptions to those services may affect BusinessMitra.

Availability and AI replies

We work to keep the service running reliably but do not guarantee uninterrupted availability. The assistant is designed to answer only from the information you provide and to hand a conversation to you when it is unsure; however, automated replies may occasionally be imperfect, and you remain responsible for the information you share with your customers. The service is provided on an "as is" basis.

Limitation of liability

To the extent permitted by law, BusinessMitra is not liable for indirect or consequential losses, or for lost profits or lost business, arising from use of the service. Nothing in these terms limits liability that cannot be limited under applicable law.

Termination

You may stop using the service at any time. We may suspend or end access if these terms are broken or if required to protect the service or other users.

Governing law

These terms are governed by the laws of India, and any disputes are subject to the courts of Uttar Pradesh, India.
